Report. Defamation lawsuit

Concern Dialog’s Senior Partner, Attorney Aram Orbelyan brought a lawsuit to receive a compensation for damages incurred due to dissemination of factual data of defamation against him.

“On 30.01.2020 the Armenian Public TV’s main news had a report with the headline “Consequence of Kocharyan’s advocate’s access to the Constitutional Court building”. The report presented as a fact the assumption that Aram Orbelyan had regular access to the administrative building of the Constitutional Court of the Republic of Armenia from May to August of 2019 by violating the prescribed order which is not true. From May to August of 2019 Aram Orbelyan did not have regular access to the administrative building of the Constitutional Court of the Republic of Armenia; moreover he didn’t violate any applicable requirement when entering any state or public area”.

Claimant Aram Orbelyan is requesting the Court to oblige the defendants National Security Service and Public TV Company to publically refute the factual defamatory information which was disseminated by the same media, as well as claiming damage confiscation caused by this defamation in the amount of AMD 2.000.000 (two million), each, from the two defendants.

Following the mentioned report broadcast, Aram Orbelyan requested from both the National Security Service of the Republic of Armenia and Public TV to provide the copies of the documents underlying the mentioned statements, for seeking legal assistance against the primary source of information; however none of the two respondents provided any meaningful response, thus we can assume that no primary source existed.
